Q&A: DWI information??

My friend received a DWI over the weekend from a Texas state trooper. He had a beer and the open container was still in the car. He took the test and the statetrooper said he took an extra step but I seen him and he didnt. I know everything is on camera which is great. He has never ever been in trouble before so it is his first offense. He also refused to take a breathalyser. The state trooper was boasting as to how many DWI he gets under his belt every week. I understand that it was very stupid to have an open container in the car but he had drank it before we left and just didnt trash it. He is 24 and was not over the legal limit. Although I am sure the Cop will say otherwise. I am looking for advice from people who have been in a similar situation, only serious advice please. What will happen to his license? What will the fine be? Can he fight this in court and plead not guilty? How likely is it that he could have the charge dropped to just a Open Container offense?

If one refuses a test it is automatic suspension. Read your state driving manual it is in there.

PS On trouble maker’s answer. I am an alkie (Recovering) and you my friend are an idiot. Just becuase people drink does not make them an alcoholic.
I have had four DUI’s in the 1980s I am a professional! LOL!

ok well i have this probelm with this girl i told my friend about it and he was no help so i just copy past what i explained to him because i didn’t feel like typing it all again but i will type up some back ground info.

When i met this girl name ashleigh she just broke up with her bf but it seem like it didn’t matter cuz she all kissing on me and stuff…so after a while she started acting diff as if she doesn’t like me any more…well it turns out she still has feeling for her ex but she keeps saying that she don’t want 2 b w/ him..then after a while i found out she cares for this other guy…ugh well here is the rest of the story that i copied and pasted:

ashleigh told me her ex cheated on me b4, i met her barely after they broke up. so i was thinking n i figured dat maybe she was using me to get bak at him or something. so i asked her ex just like this “aye i kno u cheated on ashleigh but i’ve been thinking n do u think da only reason i’m involved w/ her is to get bak at u?” like i mean it was just a question n den da dude got pissed…he got really pissed at ashleigh n she keep freaking out on me talking bout wut i sent him..so i didn’t tell her cuz i was freaking out cuz she was freaking out..but she found out by her god sister cuz i told her…n then ashleigh talkin bout “man i hate carlos” “fuck carlos” “u kno when i kissed him i was thinking about david(her ex)” like dat shit was fucked up…there is still more lol hold on

What You Need To Know If You Are Stopped For a CA DUI?

California DUI is one of the most difficult crimes for a lawyer to defend, because of the complexities of criminal DUI laws, issues on blood-alcohol, and separate California DMV administrative hearings.

You need to understand that the court or the authorities rely heavily on your breath to determine your innocence and or guilt. Your DUI lawyer needs to be well experienced with the DUI process, and DUI law to defend your California drunk driving charges. This is the first thing to do.

If you were stopped for suspicion of DUI, you need to be as polite and respectful as possible to the officer. However, you need to be firm in declining to take the tests. You are not required by law to take the DUI field sobriety tests. Even if the officer asked you to take the handheld breath test, you should decline it politely by reminding them of the California DUI law.

If you are already arrested, or someone is, it is difficult to locate him in custody. To find him, ensure that the complete name and date of birth are available. Obtaining the driver’s booking number will also be helpful.

There are cases in which the arrested driver is released on their own recognizance; there are others who are required to post bail. Locating a bail bond provider is the next step to do. California DUI cases are dual-faceted. The driver faces DMV DUI case, and a criminal court case. The driver facing California drunk driving charges has 10 days after the arrest, to request for a DMV DUI hearing otherwise, he will lose his driving privileges. Failure on your part to request a hearing will prompt the DMV to process the suspension on your driver’s license.

You will have your arraignment in court before the DMV hearing. It is at this time when you will enter your plea, guilty or not. Despite the fact that facing a jury trial makes many accused drivers nervous, it is important to fight the California drunk driving charge in court. There are California DUI cases that have an absolution verdict.

The nature of the DMV DUI hearing is to determine the status of your driver’s license. The DMV will figure out whether there are legal basis to suspend or revoke your license. There are times in which drivers are guilty as charged and yet, retain their license.

There are also cases, in which the drivers are absolved, but there is suspension or revocation of their license. Other cases end up with a conviction and suspension or revocation of license. Even with the first California DUI conviction, the convicted driver is required to serve jail time from 96hours to 6 months, DUI fines from 0 to 00, and license suspension of up to 6 months.

The driver must complete a California DUI program. He is required to present Proof of Financial Responsibility for Reinstatement. Finally, he may be given an order to install an ignition interlock device.
