William Schaap. Attorney. Graduated from the University of Chicago Law School in 1964. Has been a practicing lawyer since then. A member of the bar of the State of New York and of the District of Columbia. Specialized in the 1970′s in military law. Practiced military law in Asia and Europe. later became the editor in chief of the Military Law Reporter in Washington for a number of years. In the 70′s and 80′s he was a staff counsel of the Center for Constitutional Rights in New York City. In the late 1980′s was an adjunct professor at John J. College of Criminal Justice of the City University of New York where I taught courses on propaganda and disinformation. Since 1977 or ’78, in addition to being a practicing lawyer, was a journalist and a publisher and a writer specializing in intelligence-related matters and particularly their relationship to the media. For more than 20 years he has been the co-publisher of a magazine called the Covert Action Quarterly which particularly deals with reporting on intelligence agencies, primarily US agencies but also foreign. I understand this is a misdemeanor. Is it the prosecutors who will try to have the court give him maximum sentence? And if so, does it mean my friend will need a defense attorney to defend and argue that the sentence is too harsh?

its the judge, they will pretty much call all the shots in the case… he most likely does not need a defence attorney since it is his first offense and all…

I am currently 23 about to graduate college with a 4 year degree and applying for the marine corps officer program. I have already talked to a recruiter and have filled out my paperwork. I am worried about the criminal background check. The instructions said to put down all the incidents where I was charged even if it was eventually thrown out. I left a few things out and I am worried.
Here is my complete history of run ins with the law:
I had a DWI when I was 18, but I put this on the application and the recruiter said not a big deal because it was 5 years ago.
I was in NYC and bought a ticket for the PATH train to jersey city about 2 months ago. The turnstile wouldn’t let me through so I jumped it. There was an undercover cop and he gave me a 0 ticket for “fare evasion” I went to court on monday and the Judge found me not guilty, and I didn’t even have to pay a fine as long as I don’t get in trouble for 6 months. I didn’t put this on my application, and I am worried that this will come up and disqualify me because some people say it is a misdemeanor.
Also I got an erroneous “obstruction of justice” charge that is about to go to trial at the end of the month.I have already worked out a deal with the prosecutor and it will be a noise violation with a 0 fine. I didn’t put this on my application either, and I am worried it will come up. Even though this is only a city ordinance and a noise violation, could this disqualify me? I didn’t put this on my application either because my lawyer said it wasn’t a criminal matter.
That’s it. No speeding tickets or drug charges or anything else. Should I be worried?

The Nyc Criminal Justice System
The New York City Criminal Justice system is unique in many ways. First, the sheer size of it makes it the biggest in the world. Second, since each county has its own prosecutor, they each handle cases differently. Third, the vast difference in criminal representation is disturbing.
Most criminal defendants in NYC are either defendant by 18-b attorneys or the Legal Aid society. The ones fortunate enough to hire their own lawyers, have private criminal defense attorneys. Within each of these groups there are varying degrees of experience and competence.
Because of the size of the system, each prosecutor is extremely busy. They routinely handle over 100 cases each. It is important to know how they work and how to get the best result for your client. Often it is better for you to negotiate with a prosecutor, but in many instances, only a trial will resolve a difficult situation. Each case is different. Even after handling hundreds of cases, I still see each one as unique in its own way. Sometimes the arresting offices is an expert in the field and an excellent cop. Other times, he may be an overworked civil servant who, after making the arrest wants nothing to do with the case.
There is also a huge judiciary in NYC. The experience and temperament of judges in this city is vast. On one extreme you have distinguished jurists who are well aware of the law. The other extreme are the political hacks who get appointed because they have donated to the right politician.
The most important reason for choosing an attorney is his/her experience and wether or not you feel comfortable with him/her. It is important for your attorney to explain to you all of the applicable laws and facts that apply to your case. He should promptly return phone calls and answer questions.
