On October 21, 1984 Carrey, the respondent was arrested for the felony offenses of drunk driving and hit and run. He was advised of the “implied consent” law, Vehicle Code section 13353 (now section 23157). The respondent had requested the blood test and was asked to sign the hospital’s “Consent to Blood Test” form. After reading this form, Carrey refused to sign that form because he was taking some medicines that could affect his bleeding. He was asked to take a breath test or urine test but he continued to insist on a blood test. Subsequently the DMV issued an order of suspension to Carrey. Later the respondent had filed a petition for administrative mandamus in the superior court to which the DMV responded. The superior court issued the writ of mandate forbidding the DMV from suspending Carrey’s driving privilege. This appeal by DMV followed.
Issues:
Whether respondent’s refusal to sign the medical consent form was the pragmatic equivalent of a refusal to consent to the procedure involved?
Whether the lower court had erred in issuing the writ of mandate forbidding the DMV from suspending the respondent’s driving privilege?
Discussion:
This court held that if the driver refuses to complete one of the three tests, his driving privilege is subject to suspension. There is a strong public policy against the nightmare of drunk driving. Thus, the implied consent law should be liberally construed to effect its purpose, which is to swiftly and accurately identify drunk drivers. Consequently, the driver should clearly and unambiguously manifest the consent required by the law. Consent which is not clear and unambiguous may be deemed a refusal. The determinative factor as to whether there is a refusal is not the arrestee’s subjective state of mind, but rather the objective, fair meaning to be distilled from his words and conduct. In the case at bench, The respondent reviewed the form entitled “Consent to Blood Test” and stated he would not sign it The crux of the form is an acknowledgement that the driver has been advised of his choice of tests and that he is not physically incapable of taking the test. The form represents a sensible precaution from the hospital’s standpoint and imposes no significant additional onus on the driver. This court held that Section 13353 (e) c.v.c. grants the driver an exemption from the blood test because he is using an anticoagulant, however does not make the driver ineligible if he wishes to take a blood test. Hence, Carrey’s refusal to sign the medical consent form was the pragmatic equivalent of a refusal to consent to the procedure involved.
This court held that at that juncture, it was incumbent upon Carrey to select and submit to one of the remaining chemical tests as had been requested by the arresting officer. The respondent refused to submit to, or failed to complete, a chemical test of his blood, breath, or urine after being requested to do so by the officer. Hence this court held that the DMV properly revoked the respondent’s driver’s license.
Conclusion:
This court reverses the judgment granting respondent driver’s petition for a peremptory writ of mandate because respondent’s statement that he would not sign the hospital’s consent to a blood test and respondent’s refusal to submit to a urine or breath test constituted a refusal to submit to a chemical test for intoxication and respondent’s driving privileges were properly        suspended.

It is estimated that the average adult of about 70kg will reach the .08% limit after drinking three glasses of dry wine, five cans of beer, or four tots of spirits. However, depending on many factors that influence absorption rate, it could be somewhat lower than that. It is very easy to miscalculate your body absorption and the effects of what you have been drinking. Drinking alcohol and driving is a highly ill-advised thing to do. Nevertheless some people persist in making this mistake, and should they be caught, they have only one option – to call a really competent attorney as soon as possible.
The following gives you some idea regarding Californian law on alcohol and driving, so you know where you stand before you make that same mistake.
Probationary drivers are required to have a 0% Blood Alcohol Concentration. In other words, not a drop!
Drivers under 21 may not have a BAC of more than .01%. If they do, it could result in a four-month suspension of their drivers’ licenses and a fine of over 0.
Should drivers under 21 have a BAC of .05% or more they can incur a suspension of their drivers’ licences for a year and pay a fine of over 0.
A blood alcohol concentration of .08% or more is counted as a serious misdemeanour for drivers over 21, even for first offenders.
Anyone charged with driving under the influence of alcohol is commonly known to be guilty of DUI. This is a serious offence with serious consequences. Should you be an offender you will be charged in court, and without a doubt you need an attorney, preferably one who is experienced in DUI court cases.
According to the laws of California here are some general guidelines as to what you can expect the court’s findings to be.
The penalties for first offenders could include:
? 48 hours mandatory jail time or work service
? Their drivers’ licences could be suspended for up to six months. At the judge’s discretion this may be reduced to restricted driving. In other words the driver may be permitted to drive to and from work or school only.
? Court probation of up to five years may be decided.
? A fine up to 00.
Second offenders could face the following consequences:
? Mandatory jail or work service time of 96 hours up to one month.
? Up to two years driver’s licence suspension. Sometimes in the second year a restricted licence may be permitted.
? Up to five years court probation.
? Up to 00 fine.
If you are a third offender, you can expect:
? Mandatory jail time of 120 days to a year, with or without a rehab program.
? Up to three years driver’s licence suspension. Sometimes it may be partially a restricted licence.
? Up to five years court probation or formal probation, requiring regular reporting to a probation officer.
? Up to 00 fine.
If you have committed four or more DUI offences the courts could charge you with a felony. In this case you can expect a minimum sentence of a year in a state prison. You can expect this sentence to be ten years or more if you had an accident while driving under the influence, and caused injury or death to anyone.

He was driving drunk and had taken an ecstasy. The police officer ased him if he had any kind of drugs with him and he responded no. However, they found an ecstasy in his pocket and the police made him take a drug test. He made some jail and took his vehicle away. Now he has court this coming week and he is not sure how hard the court will hit him

I recommend that you interview several attorneys who specialize in the defense of DUI
You can look up attorneys who specialize in DUI Defnese in the Yellow Pages or you can go to The County Law library and look up attorneys in the Martindal Hubble Directory of Attorneys
Ask each attorney about his experience with DUI cases.
How many cases has he defended recently. What was the outcome of those cases.
Also a good interview question is to ask the attorney if you were not available to defend me, please give me the names of three attorneys that you respect and would recommend that I contact to ask them to defend me.
After you have done this you will have a very good idea fo what your prospects are and who the best attorneys are.
You will know much better who the good DUI attorneys are in your area than anyone here on this web site.
I do recommend that you hire a good attorney with a substantial amount of recent successful experience in the Defense of DUI.
One thing to keep in mind is that Blood Alcohol levels as measured by the Police are often 50% higher than the true Blood Alcohol level when measured by a reputable Medical Laboratory.
However it takes a very good and experienced attorney to make that defense successfully for you.
That alone often means the difference between a conviction and an acquittal.
The consequences of a DUI conviction are devastating. It is very important that you hire the best attorney that you can find.

San Bernardino County Sheriff’s Deputy M. Ramirez testified that he was driving an unmarked police car northbound on Interstate 15, traveling 70 to 75 miles per hour. In his rearview mirror, the officer saw appellant, Richard A. Dibacco’s, vehicle rapidly approaching in the No. 1 lane. Even when Officer Ramirez accelerated to 90 miles per hour, appellant continued to gain on him. Appellant zigzagged from the No. 1 to the No. 2 lane, back to the No. 1, and even onto the shoulder. He passed other vehicles, forcing some to change lanes. After appellant passed Officer Ramirez, the officer accelerated to 105 miles per hour, but appellant was still pulling away. At Bear Valley Road, appellant cut off more vehicles. Another Officer Momjian saw appellant’s vehicle driving by at a speed he estimated to be 90 miles per hour. He followed appellant and pulled him over. Appellant apologized and said he was in a hurry. On May 10, 2003, appellant was cited for reckless driving, a misdemeanor and for driving in excess of 100 miles per hour, an infraction. Appellant appeared for arraignment without counsel. The court advised him it was reducing the reckless driving charge to an infraction. The court found appellant guilty on both counts and imposed a $ 750 fine. This appeal followed.
Issues:
Whether the court improperly reduced the reckless driving charge from a misdemeanor to an infraction? Whether the Court exceeded its jurisdiction in reducing the charge?
Whether the speed of exceeding 100 miles per hour is a lesser and necessarily included offense of reckless driving?
Discussion:
1) Whether the court improperly reduced the reckless driving charge from a misdemeanor to an infraction? Whether the Court exceeded its jurisdiction in reducing the charge?
The Court states that with the consent of a defendant, a court may reduce certain specified misdemeanors to infractions. The reducible misdemeanors are listed in Penal Code, section 19.8, but reckless driving is not among them. Moreover, Vehicle Code, section 40000.15 explicitly provides that reckless driving is “a misdemeanor, and not an infraction.” Since there is no legislative authority for reducing a reckless driving charge to an infraction, the court exceeded its jurisdiction in doing so. Since “reckless driving as an infraction” is a nonexistent crime, the court lacked authority to convict or sentence appellant for it. Accordingly, the reckless driving conviction must be reversed and the case remanded for a new trial on this charge.
2) Whether the speed of exceeding 100 miles per hour is a lesser and necessarily included offense of reckless driving?
The Court states that since the only conviction is now the speeding conviction, this challenge to the sentence is moot. Nevertheless, the trial court must reconsider the sentence on remand. Under Vehicle Code section 22348, a first violation carries a maximum fine of $ 500, but appellant was fined $ 750 for the two counts. The trial court must reevaluate the sentence and decide what fine to impose for the speeding conviction alone.
Conclusion:
The court reversed the conviction for reckless driving and affirmed the conviction for speeding. The case was remanded for retrial on reckless driving and resentencing on speeding.

Here is a clip that should be compulsory for all drivers to watch once they have passed a driving test. I’m not going to preach to anyone that ‘Speed Kills’ when it has been proven that speed on it’s own is not the killer. Speed combined with any of the following 1) Drink or Drugs 2) Dangerous Driving 3) Reckless Driving …. this is what causes the accidents and kills. Please, always remember. Be safe, be alive. How Does California Traffic School Work?
Most California drivers who receive a traffic ticket have several options;
Admit guilt, accept the points, and possible increased insurance rates;
Go to court and try to fight the charges and hope that you are persuasive enough and the judge is in a good mood;
Hire a lawyer to represent you in court and take the risk that you may still be found guilty and have to pay the fines in addition to your attorney’s fees or,
Attend a traffic school and have the case dismissed (along with no points on your record and no increased insurance rates)
For most drivers, attending traffic school, if they are eligible, is the best choice.
Who Can Attend Traffic School?
The court can order anyone to attend traffic school but, in order to have the case dismissed:
The driver must not hold a class A, B or commercial class C license
The traffic offense must not have been committed while driving a commercial vehicle
The offense must not have been a serious traffic offense such as a DUI, reckless driving, or leaving the scene of a collision.
You must not have attended another traffic school that resulted in dismissal of a traffic offense within the last18 months
How to Request a Traffic School
Basically, if you want to attend a traffic school you have to request that the court “order” you to attend traffic school. This request must be made to the traffic court in the county where you received the ticket. You will still have to pay the fines for the offense and any additional fees that the court may impose on you. You will also have to pay for the traffic school. These costs are non-refundable.
Once you have been “ordered” to attend traffic school by the CA Clerk of Court, you will have a certain amount of time (depending on the county) to attend and show proof of successful completion of the course to the court. After the court receives proof of attendance, the judge can then dismiss the case.
If you do not provide proof of attendance within the required amount of time, you will be in violation of a court order; you will be charged with a misdemeanor and the traffic offense will be entered on your driving record.
Choosing a Traffic School – What type of school is best for me?
After paying the fines and fees to the court, you will be given a list of approved traffic schools within the county. Remember, you must attend a court approved traffic school in the county where you received the traffic ticket.
Online – Fortunately, most counties offer the option of completing California traffic school online. By taking the course online: You don’t have to travel back to the county where you received the ticket to attend class
You have the option of completing the course on your schedule.
You can stop the course and pick up where you left off at a later time
You don’t have to be especially “computer savvy” to successfully complete the course
Classroom – For some, attending a classroom course is the best option. If you live in the county where you received your ticket there is probably a classroom course nearby. For those who learn best by hearing instead of seeing, classroom courses offer several options: You can complete the course in one sitting
You can ask questions of the instructor to clarify issues you might not fully understand
You can learn from the experiences of others in the class
The instructor can update you on new traffic laws that you may be unaware of
Course Completion Certificate
Once you have completed the course and received your completion certificate, you have the responsibility of providing it to the court within the required time limit. The traffic school will not send it for you. You may either hand carry it to the courthouse or you can mail it in. If you mail it, make sure to mail it via “registered mail – return receipt”. That way you will receive a receipt in the mail showing when it arrived at the court and the signature of the court official who received it. Contact the court in the county where you received the ticket if you have any questions.
