A number of notable Texas traffic and driving laws meant to grow
safety on the roads and drivers
education cognisance go into effect on September 1.
Motor vehicle operators under the age of Automobile operators
will now have a harder time getting traffic violations elminated
from their 25. SB 1005 provides that if a driver younger than
automobile operators years of age commits a traffic offense
classified as a moving violation, the judge must necessitate the
driver to complete a classroom based or online defensive
driving course. In addition, if the driver holds a
provisional driver license – in other words, is under operators
years of age – they must submit to a Texas Department of Public
Safety road test in addition to taking an offline or online defensive
driving course. Failure by the driver to meet this
requirement will result in a final conviction for that traffic
offense.
Proof of insurance will be enforced through the new Texas law SB
1670. This law requires the Department of Insurance, in
conjunction with Texas Dept. of Transportation and other
authorities, to constitute a substantiation program for
automobile insurance in order to try and trim back the total of
uninsured motor vehicle operators.
SB 1257 prohibits use of wireless communications equipment
(including cellular telephones) for the first six months after
teenagers get their driver licenses. The bill also interdicts
passenger bus drivers transferring those under 18 from utilizing
wireless communications hardware, except in emergencies or when
the vehicle is stopped. Use of wireless equipment has become
omnipresent and is under suspicion of stimulating accidents.
Many of the items addressed by by these laws are discussed in
the available State of Texas defensive driving courses offered
online and in classroom settings. Prices could vary for drivers safety
courses but the lower limit they can be by law in the state
of Texas is .

CIRCUIT COURT OF THE CITY OF FREDERICKSBURG, VIRGINIA
The jury awarded damages in the exact amount of the Plaintiff’s special damages only.
Issue:
Whether the last clear chance doctrine applies to the inattentive plaintiff?
Whether the plaintiff’s conduct constituted negligence per se?
1) Whether the last clear chance doctrine applies to the plaintiff?
The Court finds that the Plaintiff knew he was standing in the travel lanes of Princess Anne Street, at twilight, in dark clothes, holding a non-reflective stop sign, while vehicles approached him. Clearly, he was not unconscious of his peril. Therefore, the Plaintiff was not an inattentive plaintiff and, as a result, the doctrine of last clear chance does not apply. Moreover, even if the Plaintiff could somehow contort himself to fit the Court’s definition of the “inattentive” plaintiff, the Defendant would be liable “only if he actually saw the inattentive plaintiff. The Defendant has always maintained that he never saw the Plaintiff prior to the collision. So, again, the doctrine of last clear chance does not apply.
2) Whether the plaintiff’s conduct constituted negligence per se?
Plaintiff was not experiencing an emergency or mechanical breakdown; he was acting as a ground guide for the driver of a large truck. Furthermore, Plaintiff is not a member of one of the classes of persons exempted from the application of this statute. Namely, on the day in question, Plaintiff was not a “law-enforcement officer, school guard, firefighter, or member of a rescue squad engaged in the performance of his duties. Moreover, Plaintiff “failed to heed traffic that was obvious and in dangerous proximity. Plaintiff saw the Defendant’s vehicle approaching yet he nevertheless attempted to impede the progress of the Defendant’s vehicle at twilight, while wearing dark clothing, and while holding a non-reflective stop sign. Additionally, Plaintiff turned his back to Defendant’s approaching vehicle. Plaintiff’s decision to recklessly expose himself to a foreseeable harm coupled with his violation of the applicable statute constitutes negligence per se.
Clearly, the Plaintiff violated the duty not to stop a vehicle of another for the sole purpose of impeding its progress per Va. Code Ann. § 46.2-818(1) (2002) when he undertook to act as a ground guide for the driver of the Coca-Cola truck and was subsequently struck by the Defendant’s vehicle. Because Plaintiff violated this duty, he was negligent. And because Plaintiff was negligent, the jury’s verdict in favor of the Plaintiff is contrary to the evidence.
The plaintiff could be found guilty of a class 1 misdemeanor and be subject to suspension of his Virginia driver’s license for up to one year. In light of these findings, the jury verdict is set-aside, as contrary to the evidence.

Question by hello: What will it take to strengthen our dui laws?
A friend of mine was seriously injured and her boyfriend was killed by a drunk driver a couple years ago. The drunk driver had 2 previos dui’s and he walked off with 5 years probation and 10 year loss of license. It would have been nice if he was sentenced to prison time. How come he wasn’t?
FYI the sentencing was just today and this happened 1 1/2 years ago.

It depends what state you’re in and the circumstances. Probation or house arrest is typical for DUI deaths. Lawmakers in MASS are trying to move harsher penalties forward. All this following 5 DUI crashes involving MASS state troopers in just one month. When someone of importance dies the laws will change. Until then hundreds of Joe Averages must die each day until then.
